Terms of Service
These Terms govern your use of Find A Trainer Melbourne and the Fitness Awards Network (including Quality Fitness Awards, award verification pages, marketplace listings, forums, and AI-assisted Q&A).
1) Who we are
Find A Trainer Melbourne (“we”, “us”, “our”) operates a fitness marketplace and recognition network that helps people find fitness services and helps fitness professionals present verified information to the public. We may refer to our recognition programs as the Fitness Awards Network, including the Quality Fitness Awards and award verification services.
2) Acceptance of these Terms
By accessing or using our website, services, listings, forum, awards pages, verification pages, forms, or APIs (together, the “Services”), you agree to these Terms and any policies we publish by reference, including our Privacy Policy.
If you do not agree, do not use the Services.
3) Eligibility and accounts
- You must provide accurate information and keep your account details current.
- You are responsible for activity on your account, including posts, listings, and submissions.
- We may refuse, suspend, or terminate accounts to protect the integrity, safety, and trust of the network.
4) Marketplace listings and submissions
Fitness professionals and businesses may create listings and submit information. You agree that:
- All details you provide (qualifications, experience, pricing, location, insurance, registrations, photos, claims) must be accurate and not misleading.
- You will not impersonate any person or business or publish third-party contact details without permission.
- We may edit, reformat, or remove listings to maintain quality, safety, and consistency.
No endorsement: A listing is not a guarantee of results, suitability, or safety. Users should do their own checks.
5) Awards, rankings, and verification
Our awards and recognitions are quality signals based on published criteria, available evidence, and our evaluation processes at the time of assessment. Where applicable:
- Winner rank (e.g., 1st–4th place) reflects comparative scoring within the relevant field and award category.
- Verification pages confirm that a certificate/ID exists in our system and that the award status is recorded as valid, expired, revoked, or under review.
- We may update verification status if we receive credible new information, complaints, corrections, or legal notices.
Misuse prohibited: You must not alter badges, fabricate awards, misrepresent ranking, or present our awards as government accreditation.
6) Quality standards and integrity
We operate a quality-led network. To protect users and maintain trust:
- We may require evidence to support claims (e.g., qualifications, insurance, business registration, reviews).
- We may remove content that appears deceptive, unsafe, harassing, discriminatory, or otherwise harmful.
- We may apply anti-fraud checks, moderation, and enforcement actions including removal, suspension, and reporting where appropriate.
7) Reviews, ratings, and user content
Users may post reviews, ratings, comments, and other content (“User Content”). By posting, you confirm:
- Your content is truthful to the best of your knowledge and based on genuine experience.
- You will not post hate speech, harassment, threats, doxxing, false allegations, or confidential information.
- You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, publish, display, and distribute User Content in connection with the Services.
We may moderate, remove, or decline content at our discretion to maintain quality and safety.
8) AI-assisted Q&A and automated features
We may provide AI-assisted tools (e.g., Q&A responses, guidance, summaries). These are informational only and may be incomplete or incorrect.
- AI outputs do not replace professional advice (medical, legal, financial) or your own due diligence.
- You remain responsible for decisions made using AI outputs.
- We may log and review interactions to improve quality, safety, and prevent abuse, subject to our Privacy Policy.
9) Prohibited conduct
You must not:
- Use the Services to deceive, defraud, or mislead.
- Post false credentials, fabricated reviews, or manipulated ratings.
- Scrape, harvest, or bulk-download data without written permission.
- Attempt to bypass security, rate limits, access controls, or verification systems.
- Upload malware or attempt to disrupt service performance.
- Use our brand, badges, or verification pages in a way that suggests endorsement beyond what is stated.
10) Payments, fees, and promotions
Some features may be paid (e.g., promoted listings, event tickets, upgrades). Where fees apply:
- Prices and inclusions will be shown at checkout or before purchase.
- Unless required by law, fees are non-refundable once the service is delivered or access is provided.
- We may offer promotional pricing with conditions and time limits.
11) Intellectual property
We own (or licence) the Services, including site design, trademarks, award systems, badges, copy, and verification formats. You may not use our IP except as permitted by these Terms or with written consent.
If we provide badges or award assets, you may use them only for the verified award holder and only while the award remains valid.
12) Third-party links and services
We may link to third-party websites (e.g., business sites, social platforms, ticketing providers). We are not responsible for third-party services or content. Use them at your own risk and review their terms.
13) Disclaimers
To the extent permitted by law, the Services are provided “as is” and “as available”. We do not guarantee uninterrupted access, error-free operation, or that listings/AI outputs will meet your needs.
Important: Nothing in these Terms excludes, restricts, or modifies rights you have under the Australian Consumer Law that cannot be excluded.
14) Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss (including loss of profits, reputation, or data) arising from use of the Services.
Where liability cannot be excluded, our liability is limited (at our option) to resupplying the Services or paying the cost of resupplying the Services.
15) Indemnity
You agree to indemnify us against claims, losses, liabilities, and expenses arising from:
- Your use of the Services,
- Your breach of these Terms,
- Your User Content, or
- Your infringement of any rights of another person or entity.
16) Suspension and termination
We may suspend or terminate access if we reasonably believe you have breached these Terms, undermined trust, or created risk for users or the network. We may remove or restrict content and listings at any time.
17) Complaints and takedown requests
If you believe a listing, review, or award claim is inaccurate or unlawful, contact support@findatrainermelbourne.com.au with details and evidence. We may request additional information and may mark pages “under review” while we assess.
18) Changes to these Terms
We may update these Terms to reflect operational, legal, or safety changes. Updates will be published on this page with a revised effective date. Your continued use after changes means you accept the updated Terms.
19) Governing law
These Terms are governed by the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts in Victoria.
